1. Acceptance of Terms
By using the Services, you confirm that you have read, understood, and agreed to these Terms and our Privacy Policy. If you do not agree, you must not use the Services.
2. Eligibility and Permitted Use
You may use the Services only if you are legally capable of entering into a binding agreement in your jurisdiction. You agree to use the Services only for lawful business or personal purposes related to software, SaaS, and digital-service use cases supported by OnSnap.ca.
3. Account Responsibilities
Some Services may require registration. You are responsible for maintaining the confidentiality of your login credentials, for all activity under your account, and for providing accurate and current information. You must promptly notify us of suspected unauthorized access.
4. User Conduct
You agree to use the Services in a respectful, lawful, and secure manner. You must not use the Services to violate laws, infringe rights, or disrupt normal operation of our platform or connected systems.
5. Acceptable Use Restrictions
- Reverse engineer, decompile, or attempt to extract source code except where expressly allowed by law.
- Access, scrape, or crawl the Services using automated tools without written permission.
- Upload malicious code, malware, or harmful scripts.
- Interfere with security controls, authentication, or service integrity.
- Use the Services to transmit unlawful, fraudulent, defamatory, or infringing material.
- Misrepresent affiliation with OnSnap.ca or impersonate others.
6. Intellectual Property
OnSnap.ca and its licensors retain all rights, title, and interest in and to the Services, including software, text, graphics, trademarks, logos, and underlying technology. These Terms grant a limited, revocable, non-exclusive, non-transferable right to use the Services in accordance with these Terms.
7. Content and Submissions
If you submit feedback, suggestions, or other content to OnSnap.ca, you grant us a worldwide, royalty-free right to use, modify, and incorporate that input to operate and improve the Services. You represent that you have the rights needed to provide any submitted content.
8. Payments and Fees
Certain Services may be paid offerings. Pricing, billing cycles, and plan details will be provided at the point of purchase. You authorize OnSnap.ca or its payment processors to charge applicable fees, taxes, and authorized recurring amounts where subscription billing applies.
If a payment method fails, we may suspend paid features until payment is successfully completed. You are responsible for all charges incurred under your account unless prohibited by law.
9. Refunds and Cancellations
Unless otherwise stated in a specific order page, offer terms, or written agreement, fees are generally non-refundable after service delivery or access activation. Subscription cancellations typically apply to future billing periods and do not retroactively refund prior charges, except where required by applicable law.
10. Third-Party Services and Links
The Services may include integrations, tools, or links provided by third parties. OnSnap.ca is not responsible for third-party content, policies, availability, or practices. Your use of third-party services is governed by those third parties' terms and policies.
11. Disclaimers
The Services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, OnSnap.ca disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant uninterrupted, secure, or error-free operation.
12. Limitation of Liability
To the fullest extent permitted by law, OnSnap.ca and its affiliates, officers, employees, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenues, data, goodwill, or business opportunities arising from or related to the Services.
Where liability cannot be excluded, our aggregate liability for all claims related to the Services will be limited to the amount you paid to OnSnap.ca for the specific paid Service giving rise to the claim in the twelve (12) months before the event, or USD $100 if no such amount was paid.
13. Indemnification
You agree to defend, indemnify, and hold harmless OnSnap.ca and its affiliates, officers, employees, and agents from and against claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Services, your content, or your violation of these Terms or applicable law.
14. Termination and Suspension
We may suspend or terminate access to all or part of the Services at any time if we reasonably believe you violated these Terms, created security or legal risk, or used the Services in a way that could harm OnSnap.ca, our users, or third parties. You may stop using the Services at any time.
15. Governing Law and Dispute Resolution
These Terms are governed by applicable laws of the jurisdiction in which OnSnap.ca operates and provides Services, without regard to conflict-of-law principles. Before filing a formal claim, both parties agree to try in good faith to resolve disputes informally by contacting the other party in writing.
If a dispute cannot be resolved informally, it will be handled in a court of competent jurisdiction, unless mandatory law requires a different process.
16. Changes to These Terms
We may update these Terms from time to time. Material updates will be reflected by revising the "Last updated" date on this page and, when appropriate, by additional notice. Continued use of the Services after updated Terms become effective means you accept the revised Terms.
